In California, all divorce is considered "no-fault" which means that each spouse is equally responsible for 50% of the marriage. Assets and debts are divided equally, and other issues such as spousal support and child custody are negotiated and worked out through the divorce process.

Uncontested Divorce

An uncontested divorce is a divorce where both parties are in complete agreement regarding all the issues or when one party chooses not to participate in the divorce process. There are no disputes over support, division of property, or child custody and you and your spouse agree to the terms of your divorce without the need for a trial.

Contested Divorce

In a contested divorce, you and your spouse are unable to reach an agreement regarding matters such as property division, spousal support, and child custody.
